Terms of Service

These Terms of Service ("Terms") govern your use of The Ant Method platform and services. By accessing or using our services, you agree to be bound by these Terms.

1. Service Overview

The Ant Method provides a platform that manages customer communications via WhatsApp Business. Our service relies on Meta's infrastructure for WhatsApp functionality.

Important: We do not guarantee the continued availability of the Meta Platform or any features. We are not responsible and bear no liability for any action taken by Meta Platforms, Inc. regarding your WhatsApp Business account or messaging capabilities.

2. Merchant Obligations

As a merchant using our services, you agree to:

• Comply with all applicable laws and regulations in your jurisdiction.
• Adhere to Meta's WhatsApp Business policies and guidelines.
• Follow our Acceptable Use Policy at all times.
• Bear sole responsibility for all message content sent through our platform.
• Obtain proper consent from customers before collecting their data.
• Maintain accurate and up-to-date account information.

Violations of our Acceptable Use Policy or Meta's policies may result in immediate account suspension without refunds.

3. Data Processing

In the relationship between you (the merchant) and The Ant Method:

• You act as the Data Controller: You determine the purposes and means of processing customer data.
• We act as the Data Processor: We process data on your behalf according to your instructions.

You must obtain explicit customer consent before collecting personal data through our platform. Customer information is stored securely in AWS RDS databases with reasonable and appropriate technical and organizational security measures.

4. Fees and Payment

• Subscription fees are payable in advance according to your selected plan.
• All fees are non-refundable unless otherwise specified.
• We reserve the right to modify pricing with reasonable notice.
• Failure to pay may result in service suspension or termination.

5. Account Suspension and Termination

We may suspend or terminate your account immediately if:

• You violate these Terms or our Acceptable Use Policy.
• You breach Meta's WhatsApp Business policies.
• Your account is flagged or suspended by Meta.
• You fail to pay fees when due.
• We are required to do so by law.

Upon termination, your access to the platform will cease and your data may be deleted in accordance with our data retention policies.

6. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

To the maximum extent permitted by law:

• Our total liability is limited to the greater of one month's fees paid or $30 SGD.
• We are not liable for indirect, incidental, special, consequential, or punitive damages.
• We are not responsible for any loss of data, revenue, or business opportunities.
• We disclaim all warranties regarding the availability or reliability of Meta's platforms.

7. Indemnification

You agree to indemnify and hold harmless The Ant Method, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service, your violation of these Terms, or your infringement of any third-party rights.

8. Governing Law and Jurisdiction

These Terms are governed by the laws of Singapore. Any disputes arising from these Terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of Singapore.

9. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email or through our platform. Your continued use of the service after changes take effect constitutes acceptance of the revised Terms.
